Regulations on planning environmental impact Assessment were issued

  Chinese Premier Wen Jiabao recently signed Decree No. 55 of the State Council, promulgating the Regulations on Planning environmental Impact Assessment. The regulations will take effect on October 1, 2009.

  The regulations, including six chapters and 36 articles, aim to strengthen the environmental impact assessment of planning, make planning more scientific, prevent environmental pollution and ecological damage from the source, and promote comprehensive, coordinated and sustainable economic, social and environmental development.

  Regulations, the relevant departments of the State Council and local people's government at or above the level of district-constituted municipalities and relevant departments, to organize the formulation of the land use planning and relevant areas, river basin, the construction of the sea, the development and utilization planning, as well as industry, agriculture, animal husbandry, forestry, energy, water conservancy, transportation, urban construction, tourism, natural resources development and related special planning, environmental impact assessment shall be conducted.

  According to the regulations, any unit or individual shall have the right to report to the planning examination and approval authorities, the planning formulation authorities or the competent environmental protection authorities any ACTS in violation of the provisions of these Regulations or any major adverse environmental impacts arising from the implementation of the planning. After receiving the report, the relevant departments shall investigate and deal with it according to law.

  The regulations require that environmental protection standards, as well as the technical guidelines and specifications for environmental impact assessment, shall be observed in conducting environmental impact assessment on plans. The technical guidelines for planning environmental impact assessment shall be formulated by the competent environmental protection department under the State Council in conjunction with other relevant departments under the State Council. The technical specifications for planned environmental impact assessment shall be formulated by the relevant departments under the State Council in accordance with the technical guidelines for planned environmental impact assessment and shall be copied to the competent department of environmental protection administration under the State Council for the record.

  A person in charge of the Legislative Affairs Office of the State Council introduced that China attaches great importance to environmental protection. The special chapter of the Environmental Impact Assessment Law promulgated in 2002 sets forth provisions on environmental impact assessment of planning, which has played an important role in standardizing and promoting the work of environmental impact assessment of planning. However, there are still some problems in practice.
